Annex K — The subordinate protocols

Annexe 11 sur 17 · ≈ 2 min de lecture · 11 paragraphes · 33ᵉ des 40 sections de lecture · rechercher dans l’ouvrage

The subordinate instruments do not figure within the “+3”: they are no more than the modalities of implementation of the three principal instruments (§6.5). The present annex sets out a reasoned catalogue of them — for each, its object, its basis and its effect. None prevails over the Charter; all are revised according to its amendment procedure.¶ 1

The constitutive statutes of the institutions. Each institution of the chain possesses a statute setting its mission, its composition, its powers and its negative mandates. Basis: the GAF. Effect: constitutive — any extension of power outside the statute is ultra vires.¶ 2

The Carthage Model Law. A model text translating the obligations of the GAF into legislative provisions ready for transposition, with variants according to legal traditions. Basis: the GAF, in conjunction with the Charter. Effect: hortatory — it binds only once voted by a national legislature.¶ 3

The data and interoperability protocol. Minimal dictionary of data, formats, provenance, quality, automatic controls and rules of sharing between institutions. Basis: the GAF; it operationalises the data protection commitment (§6.1). Effect: binding for the chain; technical condition of opposable measurement.¶ 4

The mutual recognition and enforcement protocol. Recognition and enforcement of acts between adherents: regulatory equivalence, conditions, public policy exception, avenue of redress. Basis: the GAF (solidarity clause, §5.5). Effect: binding between adherents; it yields to the applicable commercial, fiscal and constitutional law.¶ 5

The solidarity protocol. Solidarity funds and mechanisms: eligibility criteria, triggering, governance, control. Basis: the GAF. Effect: binding for adherent contributors and beneficiaries; suspendable and reversible according to the rules of withdrawal.¶ 6

The crisis protocol. Operational states of exception, temporary powers, duration, control and extinction. Basis: the GAF. Effect: binding; it can never suspend dignity, non-discrimination and redress (non-derogable floors, §6.1).¶ 7

The Court’s rules of procedure. Referral, standing to act, the taking of evidence, time limits, avenues of redress and enforcement of decisions. Basis: the statute of the Court and the GAF. Effect: binding; it conditions admissibility and guarantees a fair trial.¶ 8

The pilots protocol. Entry criteria, evaluation method, success thresholds, conditions for extension or discontinuation (Annex B). Basis: the GAF. Effect: procedural — no large-scale deployment without an evaluated pilot.¶ 9

The citizen participation guide. Sets out the four channels of the Call — adhesion, qualified petition, deliberation by sortition, transmission — their thresholds, time limits and guarantees (§6.3). Basis: the Call, incorporated by the GAF. Effect: it binds only to the extent that the GAF incorporates it.¶ 10

This catalogue is not closed: other protocols may be adopted according to needs, on the standing condition that they subordinate themselves to the Charter and follow its amendment procedure.¶ 11
